Well, it's good to know that there are people like you out there. Wizards that think that behavior like this should be expected and planned for. I'm sure when you walk out the door each day you expect to arrive home just fine, and you should. So should she. But the primary issue here, aside from the sad fact that you are yet another example of the ignorance running rampant in this country, is that people watched her being abducted and abused and did the absolute bare minimum required of them to help. What a horrible thing for her to be subjected to people with such little respect for a fellow human being. Self preservation cannot come first in NYC. It is against the law to carry non-lethal protection, such as pepper spray or mace.

Now, if you want to shoot someone at a club or through a window, guns are legal in the city.

Perhaps if she had had a gun her attacker could have taken it away from her and perhaps used it on her and the bystanders. No doubt the bystanders would then have done something to save themselves( the cowardly wusses).

If the transit authority think it is unsafe for a person to travel on their system at 2 in the morning then perhaps they need to shut down their service until it is safer. Better idea of course would be for them to employ more transit police.

There are third world countries where I doubt the attacker would have been alive or for that matter have been able to flee (if he could still walk when they are done with him) before the police showed up. LOL

Come to think of it, it is hard to believe in this day and age in the USA that a crime of this type would have been actively witnessed and nothing was done by the bystanders to stop it.

A weapon would not have helped her in that circumstance, but knowing a little self defense would have helped. If somebody bear hugs you, you can headbut them if their chin is in close proximity to your head. That will shake them up a bit.

You can also take your foot and slide it as hard as you can down their shin bone and stomp on their foot. That is guaranteed to hurt.

Going completely limp is a good trick too. An attacker won't expect that, and you will become dead weight, at which point if you're using your head when they drop you, you can think of something else to do to get away. You can't panic. You have to think.

It's a worse day in America when people think judges should rule however they see fit instead of law. No law required them to do any more than they did, therefor the ruled accordingly and correctly. It is no ones responsibility to defend you except YOURS. Should someone have helped? Maybe. Should they be legally obligated to? No! It is a selfish person who won't help someone in trouble. It is an even more selfish person who DEMANDS it!

OMFG!!! how can you say stuff like that? Maybe Firefighters are the only ones allowed to fight fires, but that doesnt mean that bystanders cant try to help people before the firefighters get there. This is not about money, or a lawsuit, this is about the lack of human decency. The rapist more than likely has mental issues, but what is the workers excuse? Lack of Caring, thats it. Also, you can't make the statement that MTA did their job. They are responible for providing a SAFE, reliable means of transportation using TAX money. Every Station should have a security guard 24/7, that is just common sense.

No one is saying bystander can't help, or shouldn't help. What this is about is this woman and her lawyers want people to be REQUIRED to help. What do you think about a law requiring you to run into a burning building, or dive into icy waters to help someone drowning? Should you be obligated by law to help others and put your life in danger? This woman didn't sue becaue the MTA's transit system didn't have the propper measures in place, she sued because she felt the employees didn't do enough to help her. They hit the panic button and alerted authorities! What more should be required? How do you forgive an attacker and not the people that called for help? Oh yea, they didn't find the attacker, she can't sue him. But the MTA has money... No good deed goes unpunished and they should not be forgiven until they pay for thier deed.

More than they were capable or allowed to do. Laws must be changed to allow people to interfere somehow without threat of being sued. Somehow our system has been twisted to where people feel they are not allowed to do more than call the police.

Again, would you consider it vindictive justice if it were you laying there being beaten or raped while others looked on, doing the bare minimum required by their job to help, rather than doing the RIGHT thing, helping a fellow human being?  What she wants, and what should happen, is a realization that someone stood there and did BARELY anything while she was violated in one of the most horrible ways possible in a PUBLIC PLACE.  People need to realize the consequences of inaction as much as the consequences of action. 

Sky-Boogy, I would like to see how vindictive you may be on your own behalf and without the coaching of an attorney if you were violated. Unfortunately, some people need to be on the receiving end of these things to understand the horror of it and I wouldn't wish that on anyone.

There ARE good samaritan laws that say you cant be sued for helping. That is a WORLD of difference from FORCING people to help! I think some of you have no clue of the implications of what you are asking for. This is not about being sued if you help and something goes wrong, this is about being sued if someone doesn't think YOU did enough to help. It is absolutely pathetic that a woman who got raped would SUE THE PEOPLE WHO CALLED POLICE!

People like me - I am in the medical field, when you go to the emergency room in the middle of the night, you expect me (us) to be there to help you! Because of staff shortages, often have to stay over on PM shift & head home in wee hours. Shame on me for being there to care for you at such an unreasonable hour!
